I find it very interesting that Jake Gyllenhaal who has a very large gay fan following would threaten a lawsuit over a supposedly fake semi-nude photo. He has been in films where his bare butt is shown.
He has hired lawyers claiming defamation of character among other things. This photo would have died a rather quick death if Gyllenhaal hadn't decided to make an issue of it by threatening a lawsuit. From an excerpt of the letter sent to queerty.com (among other gay sites) demanding removal of the picture:
"Your publication of this photo violates many legal rights of our client by, among other things, defaming him, portraying him in a false light, violating his right of publicity and constituting a false designation of origin in violation of the Lanham Act. Demand is hereby made for immediate removal of the fake picture."
The letter goes on with threats to sue for "actual and punitive damages and injunctive relief".
For its part queerty.com is refusing to remove the picture.
Fake celebrity nude photos are all over the internet. His lawsuit stands no chance. In fact I was so sure of it that I was going to post the photo here. (It's very tame.)
